Agreement

These Terms are a contract between you and Builder of All Things LLC ("ALYND," "we," "us"), a Hawaiʻi limited liability company (PO Box 700639, Kapolei, HI 96709). By creating an account or using ALYND, you agree to these Terms and our Privacy Policy. You must be at least 18 and able to form a binding contract.

Your account & pairing

• Keep your credentials secure; you're responsible for activity on your account.

• ALYND connects exactly two accounts by mutual invitation ("pairing"). Pairing shares the content the product is designed to share (heartbeats, messages, story, shared places) with your partner. Either partner may pause or disconnect the pairing at any time in Settings.

• Provide accurate information and use ALYND only for a genuine personal relationship — no impersonation, no unauthorized access to anyone else's account or content.

Subscriptions & billing

• Plans: ALYND offers an annual subscription (currently US $79.99/year, with a one-month free trial for new subscribers) and a monthly subscription (currently US $12.99/month). Prices may vary by region and may change prospectively with notice.

• One subscription covers both partners. When either paired partner holds an active subscription (or an active trial, gift, or promotional entitlement), both partners have full access.

• Auto-renewal: subscriptions purchased in-app are billed to your Apple ID and renew automatically unless canceled at least 24 hours before the end of the current period. A trial converts to a paid subscription unless canceled before the trial ends. Manage or cancel anytime in your Apple ID subscription settings; deleting the app does not cancel a subscription.

• Refunds for in-app purchases are handled by Apple under Apple's terms.

• Gift subscriptions purchased on our website are processed by Stripe, delivered as one-time redemption codes, are non-refundable once redeemed, and may require a payment method at redemption for continuation after the gifted period. Promotional programs (e.g., newlywed offers) have eligibility requirements and may be modified or withdrawn prospectively.

If your subscription lapses, live features may pause, but your existing content remains readable in the app and exportable. We do not delete your memories because a payment lapsed.

Your content

• You own your content. You grant ALYND a limited, non-exclusive license to host, store, transmit, back up, and display your content solely to operate and improve the service — not to advertise with it or sell it.

• Journal recordings are private to their creator and are shared with a partner only through the explicit in-app exchange both partners confirm.

• You're responsible for what you upload. Don't post content that's unlawful, infringing, or harmful; don't upload another person's private content without their consent.

• We may remove content or suspend accounts that violate these Terms or the law.

Acceptable use

Don't misuse ALYND: no harassment or abuse; no unlawful use; no attempts to breach, probe, or overload our systems; no reverse-engineering except as permitted by law; no automated scraping; no reselling access. ALYND is a private space for two adults — treat it, and each other, accordingly.

Important disclaimers

• Not therapy, counseling, or medical care. ALYND is a communication and relationship-enrichment tool. It does not provide medical, mental-health, or professional advice, and it is not a substitute for professional help.

• Not a crisis or safety service. ALYND is not monitored in real time and must not be relied on in emergencies. If you're in crisis, contact local emergency services (in the U.S., call or text 988).

• No outcome promises. We hope ALYND strengthens your relationship; we can't guarantee any particular result.

• The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Builder of All Things LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of ALYND. Our total liability for any claim is limited to the greater of US $100 or the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Termination

You may stop using ALYND and delete your account at any time in Settings (deletion removes your content per the Privacy Policy). We may suspend or terminate accounts that violate these Terms, harm other users, or create legal risk — with notice where practicable. Sections that by nature should survive (content license limits, disclaimers, liability limits, disputes) survive termination.

Changes to the service or terms

ALYND evolves — features may be added, changed, gated, or retired. If we make material changes to these Terms, we'll notify you in the app before they take effect; continued use after the effective date is acceptance.

Governing law & disputes

These Terms are governed by the laws of the State of Hawaiʻi, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Honolulu County, Hawaiʻi, and you consent to their jurisdiction. Nothing here limits rights you have under mandatory consumer-protection law where you live.
